Surrogate Parent
Each school district must ensure that the rights of a child are protected when:
- No parent (as defined in rule 3301-51-01 of the Administrative Code) can be identified;
- The school district, after reasonable efforts, cannot locate a parent;
- The child is a ward of the state under the laws of Ohio; or
- The child is an unaccompanied homeless youth as defined in Section 725(6) of the McKinney-Vento Homeless Assistance Act (42 U.S.C. 11434a(6)), as amended and specified in Title X, Part C, of the No Child Left Behind Act of 2001, January 2002, 42 U.S.C. 11431.
The school district is responsible for determining whether a child needs a surrogate parent and for assigning a surrogate parent to the child.
